I could be wrong but I thought it was law before they cancel your insurance they MUST send you COBRA information. I did not think they could cancel your insurance until they did that. When we went on strike a few years ago, the company did not cancel hospitalzation.

You are right, they are required to notify you of your ability to go on COBRA, but I think they have like 60 days to do so. I used to handle the insurance for my husband's company but that has been a while ago now and I can't remember the specifics of the "rules". Also, I agree about your insurance for the month of December. If they have already paid the premium for the month, you most likely will be covered for this whole month.

You or your husband should definitely contact the HR dept. at his job to figure out how the insurance issue is being handled. It's easy for us to all guess, but you need specifics now that only they can give you.

We called the union steward and he emailed human resources to find out when our health insurance lapses. Now we are just waiting to hear back from human resources. Hopefully I will have answer today or tomorrow. If not then I can sign up at work and just have a letter written up stating the husbands insurance lapsed on a certain day and my insurance would cover it. That's the latest I have found out. Working as much overtime as possible just in case the strike goes into january. They already called a mediator in don't know when that person is coming in though.
 
Personally, I would contact the company DIRECTLY and NOT just 'wait around' until intermediaries decide to act on your request.

I don't know if your insurance is thru the union or his employer, but My husbands insurance is thru his union. Whenever we have problems or questions we call the person at the union who is incharge of insurance. Something like this is something they should know of the top of their heads, also if you talk right to them, you can then ask, how to go about getting Cobra if the strike goes on, ect. IF it is thru the employer I would call HR myself, especially since they are on strike, My guess would be the steward has alot going on and working on getting you answers probably is farther down his list than it would be in normal circumstances.
 
I have no info to share but I just want to say I wish you and your DH well and hope the strikes ends quickly. There is no good time for this sort of situation but just before the holidays is really crummy.

It's not quite the same thing, but my wife's employer is going from payroll being done at the individual parrishes to a centralized system for the whole diocese. This means after my wife gets her weekly paycheck on 12-24, her next pay check won't come for 3 weeks or 1-15.(They're going to every other week plus one week delayed. Her 1-15 check will be what she would have earned 1-1 and 1-8) Such a wonderful Christmas present from the Diocese of Palm Beach to all its employees. How much did the new accountants donate to the diocese last year?

PS- I'm out of work too which means we're really in a squeeze.

Unfortunately if the strike doesn't end soon. I don't know how I can even afford it. I think It had cobra papers in it but the hubby was in a mood and tore it up. Unfortunately my plan wouldn't take affect until the new year. So I had to cancel my cardio appointment until that kicks in. Everything just keeps getting worse. And I don't know what to do. I'm so stressed out with surgery and everything else that has happened this year. I'm just am at a loss. It doesn't feel like

Do the only thing you can, throw your arms up in the air and yell. At least temporarily, it relieves the stress. Believe me, I'm so there myself.

Make sure that you have no lapse in coverage between Dec.7 and when your new coverage becomes effective. If you have a lapse in coverage, your new insurer may not cover any preexisting conditions. If you have a change in insurance carriers, with no break in coverage, you will not have to satisfy a new preexisting time period. It may be to your advantage to go on COBRA from Dec. 7 to your plans effective date.

I was JUST going to write the same thing, IF there is a lapse (meaning you don't sign up for Cobra in dec) there is a BIG chance they will either not cover anything related to your heart or maybe even will not cover anything heart (or any other medical problem you or your husband have. related for 1 year. IF you have cobra, (which you can get now even tho you've technically been uninsured sine the 7th), they can not use preexisting clauses against you because of the HIPPA law
 
Actually, you have 60 days to sign up for cobra (see the below quote). At my husband's office, we used to run into this all the time. We have a 60 day waiting period for new employees to get on our insurance plan, so most of them don't actually sign up for Cobra as the last day for the sign up is actually the first day of our coverage. Twice, we have had employees who had a medical problem come up in that 60 day period who went to the Dr. and then signed up for cobra the next day and it covered it since it is retro active to the first day you were eligeable. These employees who went without cobra were never considered uninsured by our insurance co. during that 60 day cobra time period. Also, the new insurance coverage can only use the pre-existing clause for as long as you didn't have coverage...IE...if you had coverage for 11 out of 12 months, they are only allowed to not cover your pre-existing for 1 month. Since you are applying at your works open enrollment, I'm pretty sure the insurance company has to take you and can not deny coverage for your pre-existing condition under these circumstances.

In that letter your husband tore up may have been a certificate that showed your previous coverage and the length of that coverage...you are going to need that for your new insurance to prove that you were covered for those 11 months.


"Once your insurance ends, your employer must give you written notice of your rights under COBRA. Then, you have 60 days from the date of the notice or the day your previous coverage ended, whichever is later, to decide if you want to sign up for COBRA. If you do not sign up within this time period, you cannot decide to sign up later. If you sign up, the health premiums are retroactive, so they start from the day you leave the company. The first premium payment must be made within 45 days of sign up, and you will have a 30-day grace period for the rest of the payments."


Go talk to your HR dept on Monday. You need to understand exactly what is going on in your case. If your new insurance isn't going to cover your heart (I don't think there is any chance of this) you need to know that b/c Cobra is then going to be what you need to do.
 
Jackie - it shouldn't even matter that today was open enrollment at your job. Insurance plans allow you to make changes at any time if you or your spouse have a change in employment or insurance status. You could get them to start your new coverage effective December 7 if you act quickly. Or go the COBRA route.

I would suggest telling your (impetuous comes to mind) husband to Scotch Tape all those papers back together or humble himself and request NEW copies so that you can get protected. Once that 60 day grace period expires, you are SOL.

BTW, you WILL NEED the "Continuity of Coverage" paper most likely included in those papers your husband tore up.
 
Jackie, I just wanted to chime in and wish you and your family all the best you can have during this very, very stressful time. You've been given some excellent thoughts from the others familiar with insurance rules and regulations, so please take note for your health and your family. This too shall pass..

You will get thru this. I have 3 docs I see regularly, my husband has 4, and he has been laid off til after the first of the year. Its been 2 months now. We are paying COBRA to have our insurance bridged until he goes back to work. We always were frugal, but now are cutting back on everything. Christmas too! Next year, after he goes back to work, he is getting slapped with a 45% $ increase in health insurance. The ones who don't want health care reform must either be retired or work for the government. This country is in shambles and its all from Bush, entering a war everyone told him not to get involved in, and squandering a surplus ON that war.
 
well thankfully we got a certified letter that was almost the same thing that was tore up stating that his insurance was dropped on december 7th. i am just finishing up my paperwork for the insurance at work and will submit it with the letter stating his was dropped on december 7th so there will be no lapse in coverage. i had to sign for this letter or else it would have gotten torn up too. so although i had to cancel my appointment for tomorrow i will be able to go under my new insurance will just have to wait for my insurance card to come. i was told that as soon i he gets back to work and his insurance kicks back in i would be able to cancel mine at anytime because what i could afford isn't nearly as good as what he gets under the new contract if it is settled. just thankful that i have that letter to submit with my insurance papers at work. his insurance costs went up as well when he goes back but not nearly as much as i would have to pay for the same coverage. if i tried to keep the same coverage that he has it would cost me 74 per week at work. which i think is absolutely insane. i agree with you colleen i think that something needs to be done especially for folks like us that if we lose insurance and don't find another right away we would be denied for pre-existing condition. that should not even be allowed. it is not our fault that we have health problems and we are only trying to stay alive. anyway that is the latest. this has been a horrible week. and to be honest i can't wait until this year is over hoping that the new year will be a better one. thanks everyone for all the support. it means so much. especially since this is the one place i can come to talk about all of this and know that everyone understands.
 
Well we got some good news just as we were heading up to Canada to spend christmas with my family. On the 23rd we left the house at 3:30 to head up, just as we were about an hour away from the border the husband got a call saying the union was going to vote on a new proposal. We got to my father's about 1/2 an hour after the meeting was going to start and for a couple of hours we were anxiously waiting to hear how the vote had turned out. We finally got the call and they voted to accept the new contract and go back to work on january 4th. Not only that but the company is going to approve 2 weeks unemployment and give them 2 days holiday pay. But ofcourse the most important thing is the fact that we have health insurance again!!! I was able to pick it up at work and received my insurance cards in the mail on monday so i was able to atleast get my inr tested which was a little high but nothing i was worried about as it wasn't above 4. But the husbands health insurance is so much better and is cheaper than what mine would be that i will be going back to his health insurance as soon as he starts back to work. It made for a very good christmas gift as it lifted alot of stress off of our shoulders knowing that he would be going back to work. and not having to worry about how we were going to manage. just thought that i would update everyone on the situation. now i can finally make another cardiologist appointment now that we have insurance again. hopefully it won't take too long to get in to see him.
