Anyone ever hear about Heart Failure/Valve Trouble being a "tough case" for S.S.?

I just got off the phone with my lawyer, as I go to my hearing for Social Security tomorrow, and I was just curious if anyone else who have applied or is now on Social Security have ever heard their lawyer tell them that having heart failure/valve trouble was a difficult case to prove??? :eek: :eek: This is what my lawyer told me today, even though I have all the evidence in my records....I am just curious.....and furious....LOL Thanks for any advance advice...Harrybaby666 :eek: :eek: :( :eek: :eek:
 
Yes I have! You need to get a copy of the Blue Book from SS. When it comes to the listing of impairments with the heart, the guidelines are so screwed up that in most cases, you'd have to be on deaths door to win award. I'll get you a link to the impairments section and you'll see what I mean. It's not impossible to win, it's just simply the worst impairment to try to win with. Got anything else wrong with you that your lawyer can pursue?

I spoke with my lawyer today and we are going on my other physical ailments I.E. My Diabetes and all of it's complications, my inability to walk because of the Neuropathy (Diabetic), My pain level (VERY Severe), my kidney damage from the diabetes, among alot of other things...So, the stragedy is that he is going to show the judge just how severe the diabetes has gotten, along with the amount of pain I am in 24/7 and how the diabetes affects my health in all the other lovely damaging ways...including the heart...I would certainly appreciate any help you can provide. I will be staying close by until I go to bed tonight, as my hearing is at 9:45 am tomorrow. Thanks for the help Ross Harrybaby666 :D :D :D :D
 
Look through the listing of impairments in all the areas that you may qualify. In your case, multiple problems may show impairment under SS law, but under the heart category, everyone except those so close to death are basically screwed. It needs to be rewritten with current medical knowledge and it hasn't been touched in years.

Thanks for the positive energy...Believe me, I need it after going through two days of interigation with my lawyer....I saw him Monday, and in 2 hours, he managed to really wear me out...I was feeling absolutely awful, and when I talked to him today, it was no better, so I will be glad when tomorrow is over, because if I EVEN THINK ABOUT STRESS, I start to have symptoms....Not Good...How are things with your CPap going? Harry good luck with the hearing tomorrow. It amazes me that a judge will determine the outcome. Heart valve disease is so complex it surprises me that they consider it a "tough case" you can hardly fake it.
Cardiologists and heart surgeons are very smart doctors. And of all the doctors that I have seen, none of them can tell me why my heart valves turned into "mush".
So I wish you the best. Sounds like your should definitely mention all the complications like diabetes.
(I like it when you post so I can see what the local temp is.)
 
Just a different sotry................My husband applied for SSI three months post surgery. His ONLY health problem is his heart. He had two valves installed.He has chronic a-fib. At that time we did not know about his severely leaking tricuspid valve. - Three weeks later the check was direct deposited. I do not believe he was at death's door. Ooops, I just remembered, he did have a report from rehab that he had significant exertional limitation. He was also 55 at the time. For what it is worth. The did tell us when he applied, that a lot depended on what his Dr.'s said. Can't imagine what was in the report! - Marybeth

things go well for you Harry, its sounds like you may get it despite what your attorney is saying. I do know that the younger you are ..the harder. I will be doing this very soon myself, just 2 days ago did the application. This is why Ive all my records, Ive many heart issues,coronary, peripheal, valve,subclavien(like uh 8 stents throughout me,I use alot of w-d40 :D ) and cerebrum(duh..can you tell :rolleyes: )and emphysema.... we will see .. all I know is my dr has said Im doing better since Ive retired, not as many pain meds and b/p has gone down some, :cool: sooooo fingers are crossed for us... love Yaps

I guess I should clarify this a bit. Everything about you, your work history, training, age and physical fitness, plays a factor in how S.S. determines cases. What may be favorable for a 55 year old may not be favorable for a 45 year old. It all depends on all these factors combined. There really is a very fine line on what gets approved and what doesn't.

Well, the hearing is over, and I still don't feel any better...My lawyer seemed to have alot of doubts about whether I would win, however, I wonder if he is just trying to keep me from getting my hopes up, because he made sure that I filled out an updated "fee statement" which, I am kind of glad of in a way, because it settled the long standing question I had about whether or not there was a cap on how much he could take as a percentage-I found out that he can only take a maximum of 5300.00, so at least that question has been answered. I also don't mind telling you guys that I am really wiped out from the stress he has been bringing on while preparing for this hearing...Thanks for all your help, encouragement, and suggestions, Harrybaby666 :confused: :confused: :confused:

And now the dreaded waiting begins. They put you through so many hoops. I don't know why they cannot give you the decision right then and there. They already know which way they're going. Oh well, something will never change.

Here's to a hopefully favorable decision. :)

My hubby had to fight for his about 3.5 yrs before he got his. It wasn't until he finally got his appeal in front of the judge with the "expert" on where he would ever work again that things went pretty quickly. Judge sent us the award letter within a week. The S.S. ofc called just afterwards to get all the perts for direct deposit and work out the SSI for our daughter.

Will pray that all goes thru quickly for you.

Harry, I pray you get the SS approved quickly. You deserve it. I was so lucky (if you call being so close to death) that I was approved within 3 weeks and SS called me from the main office and the caseworker asked how I was doing so she could make a dertermination that day. We talked for about 10 minutes over the phone and the next day I called my local SS office and they told me ot was approved! Thats been 2 years ago and now Im on Medicare at the age of 43. But glory to God I have it. Good luck.

Thanks for the encouraging words. I am so baffled by my lawyer's actions at the hearing yesterday that I just don't know what to think. One minute he was certain that I would get my SS, then the next he seemed to have his doubts, but here is the real cooker for ya: He still made me sign an updated fee agreement yesterday at the hearing. I am sorry that you had to reach almost to the point of death before they gave it too you. Harry - I missed your appointment!

If you get a decision you don't like, be sure to continue challenging it. I used to be a social worker and some of my folks had to continue going before SS over years and finally got it. I think SS wants to turn everyone down first time out, unless they are terminal, but if the patient continues to fight, he/she will eventually win providing the case is legitimate, as yours certainly is. Keep on keepin on.

My appointment went as smooth as I had hoped that it would, but I am not happy with the lawyer...It seems as if one minute he is sure that I will get my ss this time, and the next minute, he is telling me I don't know...he just seems so wishy washy, almost like he is getting some kind of kickback from the Social Security Administration to "misguide" me, so that I will give up...I guess I will just have to wait and see what happens, and hope that it will go through...Harrybaby666 :( :eek: :( :mad: :eek:
