Hey Friends,

I am meeting with my lawyer tomorrow and was wondering your thoughts for a list of questions for the attorney. I want to make sure not to forget something important while he is here. Any ideas, thoughts or suggestions would be appreciated.

Hi Lisa-

It looks as if there are several people here consulting attorneys re: fen phen (sp?) and a couple of other things. I have a few attorneys in my family and I'm always concerned when people publically discuss the nature of their cases because it is conceivable that the things that you and the others discuss on this forum and other forums could be monitored and used against your suit. We're all a sort of family here, but the whole world can read these forums.

It's a good question to ask your lawyer. I may be wrong here but it's always a good policy to err on the side of caution.

I am really trying hard not to let fly with all the lawyer jokes I know! When you really need one, you really need one. Nancy's sage advice is right on the money (as usual). For all of us, though, we need to remember when we are venting about doctors, hospitals, HMOs, etc., that we are making these comments in a public forum; comments that may affect the reputations of individuals or organizations might, in our litigenous culture, result in unexpected retaliations.

Mara, who is one of our lawyer heart buddies here, might give us all some general guidelines.

So, did you hear about the Japanese automobile executive who was in the U.S. trying to come up with a name for his company? Apparently, the name came flying forth unexpectedly when he was visiting one of our zoos. When a giraffe leaned over its fence and bit him in the rear-end, his exclamation became his company's brand name: Isuzu

Lisa, I agree with Nancy; don't say anything on the post. It might come back and bite you. But I, too, have seen a lawyer regarding fen-phen and this is what I learned. Make sure your lawyer explains what your benefits will be if you settle with the AHP plan versus if you go out on your own and sue. Everything about the AHP plan is fairly cut and dry. Going out on your own may be risky.....Good luck to you.

My best advice to all of you planning litigation of one sort or another is to beware what you say to anyone who is not your attorney about your case! even spouses, parents, neighbors. Don't discuss your case over lunch at the mall or anywhere in public. I think Nancy hit it on the head. Some law clerk surfing the net sees Lisa's post and goes "hmmmmm, gotcha" then you have divulged pertinent info.

I am not sure, Lisa, what you suing over. If it's fen-phen or redux my advice is to watch out. There are so many class actions going on the plaintiffs' counsel are singing up anyone and then when the payout comes the lawyers take their two-thirds and you victims get stuck with the chump change. Unfortunately, I think once the class is approved you'll have a hard time getting a case in any other way. Most judges in federal court don't want to hear 20,000 individual fen-phen cases, thus class action suits are filed. In a class action, the lawyers get most of the award. Did you see "Erin Brockavich" that's a good example of a class action, those folks were lucky to have gotten the amounts they did, most class actions give you a small amount and you have to wait forever to get it. The Love Canal plaintiffs are still waiting. Some IUD plaintiffs are still waiting. Appeals go on and on. A lot of class actions are filed on credit card providers and the payouts are like $5 per cardholder. Big Whoop! Some lawyer got $500,000 for trying the case.

If your case is something like John's I say hire a lawyer and go for it. John's case is a good one.

Most importantly, shop lawyers as you would shop anything, like cars, doctors and houses. Don't fall in love with the first one. Get a recommendation from a friend. If you know a lawyer ask him or her who they'd go to.

You'll all be receiving a bill for this advice (ha ha)

Any tips in how to negotiate fees with attorneys? I am going in for a Thallum test Monday, right and left heart cath on Friday already dx. with severe aortic reg. and mild/mod mitral.
