I just couldn't hold it in anymore....I found out today that I will be getting my Social Security.....Finally! After 5 Long Years....Then I can tell my Lousy Lawyer to Go POUND SAND....(I have often wondered whether he was working for me or for Social Security-Just by the way he acted / acts..) I am just busted with excitement.... :D :D :D :D :D :D :D :D :D Harrybaby666

Yes, I am relieved as well, now I can 1. pay the lawyer and tell him to go pound sand and 2. buy a car which I need very badly...I ended up calling the Office Of Hearings and Appeals in Manchester and spoke to my case technician, who then checked on it...it still might take 8 weeks to get the written decision, but at least I now know....WHEW!!!! :eek: :eek: :eek: :D :D :D :D Harrybaby666 :D

Yes, I am thrilled to be finally getting the Social Security, because now I can really get going on my goal of owning my own home and finally buying that car that I need so badly. All I can say is....I NEVER WANT TO GO THROUGH THIS MESS AGAIN IN MY LIFE!!!!! I think that they finally realized that I am not in good health, and that I really need it. Especially now that I have Pulmonary Hypertension....that really messes things up...anyway, thanks for all your encouragement and I am sending you huge amounts of hugs and hoping your feeling better and better as each minute passes... Harrybaby :D :D :D
 
Well after hearing of your delema and knowing how worried you were, I sent "The Boys" to have a little talk with the ALJ. They said he was very cooperative and would see to it that you were taken care of, so I'm pleased to hear that we got results. :D

P.S. Be careful spending. It doesn't take much to blow away your back benefits! Also, if the back benefit is large enough, part of it may be taxable. I know the feeling to have been approved, but don't get overly happy. They usually find a way to snatch some of it back.

Hi Harry!! I'm so happy for you for it was something that was really getting you down. Don't forget to include a digital camera in your shopping list! LOL! By the way Milady advanced on my mother this morning. Seething with rage, her face was twisted and contorted beyond all recognition in an evil and chilling bloodthirsty snarl. Foaming at the mouth, her crinkled snout and smouldering eyes threatened as she poised for the attack. Slavering and dripping, her hackles raised, she bared her teeth and prepared for a rabid onslaught, her pink gums in a vampire-like position. And as she pounced, she sank her teeth into my mother's pants, causing irreparable damage to the unfortunate fabric. But don't imagine she has rabies, she has all her vaccines. It was just her little way of showing her feelings of genuine love for all the family. Canging the subject, I've just confirmed my appointment and I must say that so far, I've been feeling quite calm. I loved the chat last night, thanks for your support.

I already asked about this, and I will have 4 months to spend the back benefits down to a maximum of 3000.00. I pretty much have it all spent anyway, paying off credit cards and buying a new car. I would like to know though in what ways could they snatch some of it back? They gotta know that I also still have to pay the lawyer...? Harrybaby666 :D :D :D

P.S. Is this how you sent "The Boys" To take care of the ALJ??? LOL It seems fitting for a government agency that is as slow as they are... :D :eek: :D
 
Unless you've made other arrangements (Your attorney should have had you file a fee agreement with SS by law), they pay the attorney out of your back benefit and the most that clown can get used to be $3000 or a 20% I think it was. I'd have to check on the new guidelines. Heck that was the fastest $3000 grand my attornery ever made. One phone call!.

The way they get you is,
1. Miscalculate your benefit then pay you too much, then let it go for a year or so, then suddenly want the money back. They screwed me 3 times this way because at the time, I got benefits for my kids too.
2. Medicare!!!!! Your about to lose another 17% at the first of the year.
3. Depending on how large a back benefit, it will be taxed in the year that it is received if applicable.

2018.2 How does SSA authorize fees?
We have two methods of authorizing representative's fees: The (1) fee agreement and (2) fee petition processes.

If you and your representative elect to use the fee agreement process, you must file a written agreement with us before the date on which we make a favorable determination or decision on the claim. We usually approve the fee agreement if:

Both you and your representative have signed it;

The fee specified in the agreement does not exceed 25 percent of the past-due benefits or $4,000, whichever is less;

Our determination or decision in the claim is fully or partially favorable; and

The claim results in past-due benefits.

Thanks for the information...I will keep a close eye on what is happening so I won't be caught off guard...my lawyer is getting 25% or 5300.00 which is the most he can take....this will be interesting to see what happens with this, because I have also heard that the lawyer can take your back pay and let it sit in his bank account and collect interest.....I hate to think of this happening, but nothing surprises me with this Bozo lawyer I have....Have you heard of them doing that ?
